How to appeal a commercial assessment in Cuyahoga County
8 steps from the notice to the Cuyahoga County Board of Revision and beyond, with the forms, exchange deadlines and mistakes that decide commercial cases here.
Deadline
Complaint (DTE Form 1) filed with the Board of Revision between January 1 and March 31 of the year after the tax year, or by the close of first-half collection for the tax year if that is later (R.C. 5715.19(A)(1))
Where to file
Board of Revision e-Complaint system (no notary required for electronic filing); paper DTE Form 1 by mail or in person
Statute
R.C. 5715.19 (complaints to the Board of Revision); R.C. 5717.01 and 5717.05 (appeals from the Board)
The process, in order
Each complaint is set for a sworn evidentiary hearing before a hearing panel acting for the Board of Revision, held in person or by video. The complainant presents first, any counter-complainant (often the school district) follows, and the Fiscal Officer's appraisal staff may respond. Hearings are short and evidence-driven: the panel questions witnesses directly and can ask for additional evidence after the hearing but before it decides.
Forms you will need
- +DTE Form 1, Complaint Against the Valuation of Real Property
- +DTE Form 2, Counter-Complaint Against the Valuation of Real Property
- +DTE Form 4, Notice of Appeal to the Board of Tax Appeals
- 1
Before January 1 of the filing year
Confirm the cycle and the triennial history
Identify whether the tax year is a reappraisal, update or interim year, pull the prior three years of values, and check whether a complaint has already been filed on the parcel in the current triennial period.
- 2
During the Fiscal Officer's informal review window (summer of the reappraisal or update year)
Use the informal review in reappraisal and update years
Submit an appraisal, sales or condition evidence to the Fiscal Officer while values are still tentative. A change here can avoid a formal complaint entirely.
- 3
As soon as the tax bill arrives in January
Build the evidence package
Assemble rent rolls and leases as of January 1, certified income and expense statements or federal return schedules, any purchase documents within a year of the lien date, and engage an appraiser who will testify.
- 4
January 1 to March 31 of the year after the tax year
File DTE Form 1
File through the Board's e-Complaint system or on paper. Confirm that the signer is the owner or an authorized filer under R.C. 5715.19, and complete Line 15 if a prior complaint exists in the triennium.
- 5
After the filing window closes
Watch for counter-complaints
School districts track Board of Revision filings and may file a DTE Form 2 counter-complaint, then appear at the hearing with their own appraiser. Plan the evidence as if the district will contest it.
- 6
At least 7 business days before the hearing date
Submit evidence before the hearing
Upload the appraisal, income analysis, sales grid and exhibits. Late or unauthenticated evidence may be refused.
- 7
As scheduled by the Board, generally in the months after filing
Attend the hearing
Present the owner or manager and the appraiser under oath. Answer the panel's questions on vacancy, rent and expense normalization directly.
- 8
Within 30 days after the decision is mailed
Appeal within 30 days
File a notice of appeal with the Ohio Board of Tax Appeals and the Board of Revision, or with the Court of Common Pleas, the Board of Revision and the Fiscal Officer.
Mistakes that lose Cuyahoga County appeals
- Letting an unlisted agent sign the complaint for an LLC owner; the filing is void and cannot be cured after March 31.
- Filing a second complaint in the same triennial period without a qualifying Line 15 exception, which leads to dismissal.
- Submitting an appraisal without the appraiser present to authenticate it and face cross-examination.
- Valuing the leased fee (in-place leases) instead of the fee simple estate the statute requires.
- Filing the BTA notice of appeal with the BTA but not with the Board of Revision, or missing the 30-day window.
Evidence rules
- 1.All evidence is requested 7 business days before the hearing and must relate to the January 1 lien date of the tax year at issue.
- 2.The Board may refuse evidence that was not timely submitted, or that is not authenticated or cannot be cross-examined because its author is absent.
- 3.A witness with personal knowledge (the owner, property manager, appraiser or other expert) must appear to support the business records, operations or condition of the property.
- 4.Income-producing property: submit lease agreements and rent rolls with certified income and expense statements or the relevant schedules of the owner's federal return.
- 5.An appraisal must be authenticated by the appraiser at the hearing; a report submitted without the appraiser present is given little or no weight.
Frequently asked
When can I file a Board of Revision complaint in Cuyahoga County?
Between January 1 and March 31 of the year after the tax year (or by the close of first-half collection if that is later). A complaint on tax year 2026 values is due by March 31, 2027.
Can I appeal every year?
Generally once per triennial period. A second complaint in the same period is allowed only for a listed change after the prior lien date: an arm's-length sale, a casualty, a substantial improvement, or an occupancy change of at least 15% with a substantial economic impact.
Can the school district raise my value?
It can counter-complain against an owner's complaint and argue for a higher value at the hearing. Since House Bill 126, an original complaint by a school district requires a qualifying sale and a board resolution, and the district cannot appeal the Board of Revision's decision to the BTA.
Does my appraiser need to attend?
Yes. The Board expects appraisals to be authenticated by the appraiser at the hearing, and evidence whose author is absent for cross-examination may be disregarded.
