How to appeal a commercial assessment in San Diego County
8 steps from the notice to the San Diego County Assessment Appeals Board and beyond, with the forms, exchange deadlines and mistakes that decide commercial cases here.
Deadline
Regular assessments: application filed with the Clerk of the Board of Supervisors between July 2 and November 30 (moved to the next business day when November 30 falls on a weekend or holiday). Supplemental and escape assessments: within 60 days of the date on the tax bill
Where to file
Clerk of the Board Assessment Appeal online portal, or the paper Assessment Appeal Application filed by mail or in person at the County Administration Center
Statute
Cal. Rev. & Tax. Code §1603 (application for reduction) and §1604 (two-year rule); Property Tax Rules 301 to 326 (Cal. Code Regs. tit. 18)
The process, in order
Hearings are held before a three-member Assessment Appeals Board panel appointed by the Board of Supervisors and independent of the Assessor. The Clerk mails the hearing notice at least 45 days ahead, and parties confirm attendance no later than 21 days before the hearing. The applicant presents first, the Assessor responds, and the Board may announce its decision at the hearing or mail it later. Each party gets one postponement, requested at least 21 days before the hearing, and failure to appear can lead to denial.
Forms you will need
- +Assessment Appeal Application (BOE-305-AH, Application for Changed Assessment)
- +Authorization of Agent/Designation of Attorney
- +Economic Unit Supplemental Page for Additional Parcels
- +Agreement to Extend Time for Assessment Appeal Hearing (2-Year Waiver)
- 1
July, when the roll closes
Confirm the enrolled value and base year
Pull the APN's current assessed value, base year, and any supplemental or escape bills. Compare the factored base year value with a lien-date market value estimate to see whether a Proposition 8 reduction is available.
- 2
Spring window set by the Assessor each year
Request an informal Assessor review
Submit the decline-in-value review request with the rent roll and operating statement. A favorable result can resolve the year without a hearing; an unfavorable one still leaves the formal appeal open.
- 3
July 2 to November 30 (60 days from the bill for supplemental or escape assessments)
File the Assessment Appeal Application
File with the Clerk of the Board through the online portal or on paper. State both values, request findings of fact if a court appeal is possible, and attach the agent authorization if a consultant or attorney files.
- 4
At least 30 days before the hearing; response at least 15 days before
Exchange information
Serve a Rule 305.1 exchange with the income approach, sales and expense analysis. After an exchange, the hearing is generally limited to the matters exchanged, so put the full case in the exchange.
- 5
When the assigned appraiser asks
Respond to Assessor information requests
Provide leases, rent rolls and operating statements requested under §441(d). Data withheld from the Assessor is hard to introduce later.
- 6
Notice at least 45 days ahead; confirm 21 days before
Confirm the hearing
Confirm attendance through the portal or by mail. Request any postponement at least 21 days before the hearing; each party gets one.
- 7
Hearing date, often several months after filing
Present to the Assessment Appeals Board
Present the income approach and sales evidence, rebut the Assessor's valuation, and bring multiple copies of the binder. The Board decides within the two-year period unless a waiver extends it.
- 8
After the decision; suit within six months of a claim denial
Refund claim and Superior Court
If the Board does not reduce the value, pay the tax, file a claim for refund, and bring a refund action in Superior Court on the administrative record.
Mistakes that lose San Diego County appeals
- Leaving the opinion of value blank on the application, which can make the application invalid.
- Filing with the Assessor or Treasurer-Tax Collector instead of the Clerk of the Board; filings sent to other County offices are not valid.
- Holding back evidence that was not in the Rule 305.1 exchange and then finding it excluded at the hearing.
- Using sales more than 90 days after the January 1 lien date or income figures that reflect business income rather than real property income.
- Skipping the request for written findings, which weakens any later Superior Court refund action.
Evidence rules
- 1.Exchange of information under Rev. & Tax. Code §1606 and Property Tax Rule 305.1: the initiating party submits its data with the application or at least 30 days before the hearing, and the other party responds at least 15 days before. Once an exchange occurs, evidence at hearing is generally limited to matters covered by the exchange unless the other side consents.
- 2.The Assessor may request information under §441(d) before the hearing; if the owner withholds requested information and then introduces it at the hearing, the Assessor is entitled to a continuance under §441(h).
- 3.Comparable sales should be close to the January 1 lien date; sales occurring more than 90 days after the lien date are not admissible (Rev. & Tax. Code §402.5).
- 4.Written findings of fact must be requested on the application or before the hearing begins, and are needed if the owner may later go to Superior Court.
- 5.Bring multiple sets of the evidence binder to the hearing; the Clerk recommends five copies for the panel, the Assessor and the record.
Frequently asked
Is there a fee to file an assessment appeal in San Diego County?
No. The Clerk of the Board does not charge a fee to file an Assessment Appeal Application. Written findings of fact, if requested, may carry a separate charge set by the County.
How long does a commercial appeal take?
Hearings are often scheduled several months after filing, and state law gives the Assessment Appeals Board two years from the filing date to decide. If that period runs without a hearing or a signed waiver, the applicant's opinion of value generally becomes the enrolled value.
Does a Proposition 8 reduction carry forward?
Only while market value stays below the factored base year value. The Assessor reviews the value each lien date and can restore it toward the factored base year value as the market recovers, without the 2% cap applying to that restoration.
Can a consultant file for an LLC owner?
Yes. A tax agent or attorney can file and appear, but the Authorization of Agent/Designation of Attorney must be filed with the Clerk, and online agent filings must upload the signed authorization with the application.
