Hospitality playbook
Hotel property tax appeals that tax the real estate, not the hotel business
A hotel's income statement belongs to an operating business. Room revenue, food and beverage, parking and fees flow through a company that depends on a brand, a management team, an assembled workforce and furniture, fixtures and equipment. Property tax reaches only the real property, so value tied to the business, the flag and the FF&E has to come out before hotel income can say anything about the real estate.
ATALI ELECTRIC builds the hotel pro forma on USALI departmental lines, deducts management fees, franchise fees and a reserve for FF&E replacement, and then removes the return on and of FF&E and the value of intangible business assets as separate, visible steps. RevPAR, ADR and occupancy are normalized against the hotel's own history and its competitive set, so the board sees a sustainable income stream instead of one strong year.
Where assessors get hospitality wrong
- 01Business enterprise value left in the real estateCapitalizing total hotel income taxes the brand, the management agreement and the workforce along with the building. California appellate courts held in SHC Half Moon Bay, LLC v. County of San Mateo (2014) and Olympic and Georgia Partners, LLC v. County of Los Angeles (2023) that deducting management and franchise fees alone did not remove all intangible value.
- 02FF&E counted twiceFurniture, fixtures and equipment are commonly assessed as business personal property. When the real property value also carries the income FF&E produces, the same assets are taxed on two rolls.
- 03Peak-year income capitalizedA citywide convention, a one-time event or a strong group year can lift RevPAR well above what the hotel sustains. Capitalizing that year as if it repeats overstates value.
- 04Expense ratios from the wrong service levelFull-service hotels carry food and beverage, sales and labor costs that select-service models never see. Applying a lighter expense ratio inflates NOI before any intangible question arises.
- 05Brand-required capital ignoredA property improvement plan imposed at sale or franchise renewal is a cost every buyer deducts from price. Assessments that treat the hotel as fully renovated miss it.
How the three approaches weigh in
Income
PrimaryCapitalization of normalized hotel NOI after management fees, franchise fees and FF&E reserve, followed by separate removal of FF&E and intangible business value.
Sales Comparison
SupportingHotel sale prices are going-concern prices that include FF&E and the business. Each sale needs the same allocation before it says anything about real property value.
Cost
SupportingA useful check for newer hotels because depreciated cost of land and improvements excludes intangibles by construction, provided obsolescence and entrepreneurial incentive are supported.
Equity Uniformity
SupportingAssessed value per key of competing hotels grouped by chain scale, service level and vintage.
How the income engine normalizes a hospitality P&L
| P&L line | Treatment |
|---|---|
| Rooms revenue | ADR and occupancy normalized over several years and against the competitive set; one-time event and group demand adjusted out. |
| Food, beverage and other operated departments | Departmental profit only, with business-driven outlets such as restaurants and spas reviewed for their contribution to business value. |
| Departmental and undistributed expenses | USALI expense lines carried at actual where in line with hotels of the same service level; owner-specific costs flagged. |
| Management fees | Base and incentive management fees deducted at market rates even when the owner self-manages. |
| Franchise fees | Royalty, marketing, reservation and loyalty program fees deducted per the franchise agreement. |
| Reserve for FF&E replacement | Deducted as a percentage of total revenue in line with the management agreement and market practice. |
| FF&E and intangible business value | Return on and of FF&E removed, and the value of the flag, management agreement and assembled workforce isolated and deducted as separate lines. |
The roll carried the 2018 base year value, factored forward at up to 2% a year, at $118.4 million, while RevPAR on the January 1 lien date remained below acquisition underwriting. A Proposition 8 decline-in-value analysis that capitalizes normalized income after management fees, franchise fees and an FF&E reserve, then removes a return on and of FF&E and the value of the flag, management agreement and assembled workforce, indicates $97.6 million. Enrolling the lower market value for the year saves about $249,600 at a 1.2% tax rate.
Evidence checklist

- Competitive set performance reports (occupancy, ADR, RevPAR index)
- Management and franchise agreements with fee schedules
- FF&E fixed asset register and business personal property filings
- Property improvement plan and capital budget
- Group and event booking pace reports
- Purchase price allocation from the most recent acquisition
- Assessment notice and the property record card
Hospitality appeal questions
What is business enterprise value in a hotel appeal?
It is the value attributable to the hotel as an operating business rather than as real estate: the brand affiliation, the management agreement, the assembled workforce, customer relationships and similar intangibles. Most states tax only real property on the real property roll, so that value has to be identified and removed.
Is deducting management and franchise fees enough to remove intangibles?
Deducting those fees, often called the Rushmore approach, is common practice, but California appellate courts have held it does not by itself remove all intangible value, in SHC Half Moon Bay (2014) and Olympic and Georgia Partners (2023). Treatment differs by state, so ATALI ELECTRIC shows the fee deduction and each additional intangible removal as separate lines the board can accept or reject individually.
How is FF&E handled?
FF&E is usually assessed separately as business personal property. The engine deducts a replacement reserve from income and removes a return on and of the FF&E investment from the real property value, so the same assets are not taxed twice.
Does a pending property improvement plan reduce value?
A brand-mandated PIP is a cost any buyer would deduct from the price on the valuation date. The binder includes the PIP scope and cost estimate and deducts the unspent portion as of that date.
